Can my son take full custody of his child, if his girlfriend is psychologically incapable?

My son and his girlfriend lives together. He works away during the week. She has always had him take the baby with him to work. He has a babysitter. She is bipolar, yells and is high-strung. He is afraid to leave the baby. Should he seek sole custody? She said she will sign it right away.

If she will voluntarily give up custody, easily done. If not, a court rules after he brings he argument and reasons for it. Just petition for custody in Family Court.
