How can I terminate the father's rights if I have custody of a sixteen year old?

My husband and I have full custody of a sixteen year old. Both her parents are in prison. We would like to terminate the father's rights. He has never supported or had a relationship with her but refuses to let us change her last name to ours or anything. The mother agrees to the name change etc. The child requested the name change to blend in with our family. We support her 100% with no help from either of the parents.
