How can a parent who is in jail sign over custody to someone else?

How can a parent who is in jail sign over custody to someone else without a court hearing or without the birth mother knowing?

This is not a process that is done outside of court. Additionally, if the mother still has legal rights to the child, she would have to be notified of the proceedings.
