How does my husband get custody of my children?

I just remarried and have a wonderful husband who has been very active in the life of my children for many years. My children are ages 5 and 3. Does my husband just need to adopt my children? Is this something that we can do on our own?

Before you can have your husband adopt your children, you will need to terminate the parental rights of the biological father. If their father has custody orders and/or has been involved in the lives of your children, it might be difficult to do and legal counsel would be helpful. So there are really two steps to the process (termination and adoption), and the complexity of the case will depend on the involvement of biological father or lack thereof. These proceedings are handled by the Juvenile Court in Arizona.
