What do I do to get custody of my son?

I want to get custody of my 14 year old son and he also wants to move in with me. I pay child support and live in a 3 bedroom home with my wife and stepson. What process do I have to do?

While the court considers many factors when determining custody, including the preferences of the teenage child, the ultimate legal standard applied by the court is the best interest of the child. If there has been a change in circumstances since the last custody order in which a modification of that order would be in the best interest of the child, then the non-custodial parent may file a petition to modify the existing custody order in family court. I suggest meeting with an attorney in person to discuss your grounds for petition prior to filing.
