What is the process to change custody of child?

I have an 8 year old son who goes to live with his dad during summer vacation and on some weekends. He is asking me if he can live with his father. Do I have to go to court so he can do so?

As long as you and the child's father agree to the new custody arrangement the court doesn't to have to be involved. However, once custody changes the father may want to formalize the arrangement by obtaining a court order or a written stipulation stating that he is the new custodial parent. He would also have the right as custodian of the child to child support pursuant to the Child Support Standards Act.

If both parents are in agreement they can file a stipulated change.
